Guidelines for Utilization of Vietnam’s Biological Resources Published National Institute of Biological Resources (NIBR) announced that “Guidelines for Access and Benefit-Sharing (ABS)* Procedures in Vietnam” were released on 26 November that explains how to access Vietnam’s biological resources in compliance with the Nagoya Protocol. *ABS (Access and Benefit-Sharing) is a principal concept established under the Nagoya Protocol that refers to the way in which genetic resources may be accessed and shared equitably. Users who seek to access genetic resources from a foreign country, must get permission from the country, and share the benefits arising from their use with the provider country. This book is the 4th series of guidelines that provide ABS information on foreign countries that have established ABS legislations including India, South Africa, and Kenya in 2019. Each country’s ABS legislations have a different level of requirements so that Korean biotech companies are required to study each ABS procedure for complying with the Nagoya Protocol. Vietnam is rich in biodiversity and has high proportions of endemic species. The country enacted “Biodiversity Law” in 2008 that specify ABS provisions to regulate their biological resources. The country also established “Decree No.59/2017 on the management of access to genetic resources and the sharing of benefits arising from their utilization” that specify detailed provisions in November 2017 since the Nagoya Protocol entered into force in October 2014. The book explains not only access and benefit-sharing systems in Vietnam but also practical information that details Prior Informed Consent, Mutually Agreed Terms, and online access procedures to use Vietnam’s biological resources. According to the Vietnamese ABS regulations, foreigners who intend to use Vietnamese biological resources need to request a license to access the resources and conduct a joint research with Vietnamese researchers. For utilizing Vietnamese biological resources, user registration, ABS contract, and application for certification of approval are required to comply with the Vietnamese ABS procedures. In particular, more careful attentions are needed when accessing Vietnamese biological resources as they specify “Derivative” to be subject to their ABS procedures under the Article 3.6 of the Decree No.59/2017. Genetic Resources Information Center of NIBR has provided ABS information of foreign countries that had established ABS legislations and regulations including Vietnam to Korean biotech companies through the center’s website (www.abs.go.kr) since 2018. The book will be distributed to central and local government agencies, bio-industry, libraries, and other relevant institutions in Korea. |
